MEETING DATE: September 22, 2008 TOPIC: Consideration of Resolution No. 08 -104: Marshan Meadows 2nd Addition Final Plat Extension VOTE REQUIRED: Simple Majority BACKGROUND On January 14, 2008 the City Council adopted Resolution No. 08 -08, approving the Final Plat for Marshan Meadows 2nd Addition, a two lot residential subdivision on the east side of Stage Coach Trail, approximately 300 feet south of Park Court. Final Plats are required to be recorded within 90 days, and the applicant did not meet this deadline. They have requested additional time to record the final plat, and for the purpose of record keeping and ongoing monitoring of all approvals extended at this time, staff is recommending the deadline be extended to April 31, 2009. The escrow account for Marshan Meadows 2nd Addition has a balance of $2,341.91 which the city will continue to hold for eventual conversion to the development agreement. The development agreement is still valid until the new deadline of April 31, 2009. However, the title commitment documents that were submitted with the final plat approval are now far past valid and new commitment documents will need to be submitted along with the development agreement and financial securities prior to receiving a signature on the final plat mylar. RECOMMENDATION Staff is recommending adoption of Resolution No. 08 -104 approving an extension of the Final Plat approval, subject to the following conditions: 1. The Final Plat for Marshan Meadows 2nd Addition must be recorded by April 31, 2009; unless an additional extension is granted by the City Council. 2. All conditions of approval for Resolution No. 08 -08 will continue to apply to the site. 3.
