• <br />Council Member o ' Donnel lintroduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 08 -106 <br />RESOLUTION APPROVING AN EXTENSION OF TIME ON THE CONDITIONAL USE <br />PERMIT FOR PLANNED UNIT DEVELOPMENT AND THE PLANNED UNIT <br />DEVELOPMENT — DEVELOPMENT STAGE PLAN FOR MOON MARSH. <br />WHEREAS, review and approvals of plats are governed by state statutes and City <br />ordinances, and <br />WHEREAS, the Conditional Use Permit for Planned Unit Development, and the Planned <br />Unit Development — Development Stage Plan for Moon Marsh were approved with <br />Resolution 07 -142 by the City Council on September 10, 2007, and <br />WHERAS, the city's Subdivision and Platting Ordinance requires the final plan be <br />submitted within one year of approval, and <br />ID WHEREAS, a request has been submitted to the City to extend the time allowed for <br />submittal of a final plan upon approval by the City Council, and <br />WHEREAS, the Conditional Use Permit for Planned Unit Development, and the Planned <br />Unit Development — Development Stage Plan for Moon Marsh are still in compliance <br />with City requirements. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes <br />hereby approves an extension to the submittal time of the final plan for Moon Marsh, <br />subject to the following conditions: <br />1. The escrow account for the Planned Unit Development — Development Stage <br />Plan must be paid in full. <br />2. The complete final plan application for Moon Marsh must be submitted by <br />April30, 2009. <br />3. All conditions of approval for Resolution No. 07 -142 will continue to apply to the <br />site. <br />Passed by the Lino Lakes City Council ' 2nd da of September 2008. <br />Joh J.
