MEETING DATE: September 22, 2008 <br />TOPIC: Consideration of Resolution No. 08 -107: <br />Century Farm North 5th Addition <br />• Planned Unit Development Extension of Time <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />The Century Farm North project received preliminary plat approval in 2003 with Resolution No. <br />03 -60. The approval included a phasing plan that would allow the final platting of certain <br />dwelling units annually over five years time. The City's subdivision ordinance requires that a <br />final plat be submitted within one year of the final plat of the previous phase. The City Council <br />previously adopted Resolution 07 -165, which allowed the developer until December 31, 2008 to <br />submit the final plat for the fifth phase. The developer has asked for another extension. <br />The city's growth management policy monitors both lots platted and MUSA allocated. This <br />development originally was allocated 33 lots and 9.4 acres of MUSA in 2007. As development <br />has slowed, these can easily be provided for within the 2009 lot and MUSA allocations. <br />Each phase of Century Farm North requires the creation of a new long term escrow account, so <br />no money is currently held by or owed to the city in regards to the fifth phase. A full final plat <br />application will be required when the developer is ready to proceed, which will include an <br />escrow deposit per the city's fee schedule. <br />RECOMMENDATION <br />Staff is recommending adoption of Resolution No. 08 -107 approving an extension for the Final <br />Plat submittal, subject to the following conditions: <br />1. The complete Final Plat for Century Farm North 5th Addition must be submitted by <br />April 31, 2009; unless an additional extension is granted by the City Council. <br />2. All conditions of approval for Resolution No. 03 -60 will continue to apply to the site. <br />3. The 9.4 Acres of MUSA reserve assigned to Century Farm North 5th Addition by <br />Resolution No. 03 -60 shall not be reallocated to a different project if the final plat for <br />the 5th Addition is submitted by April 31, 2009. <br />ATTACHMENTS <br />1.
