MEETING DATE: September 22, 2008 <br />TOPIC: Consideration of Resolution No. 08 -109: <br />The Preserve Extension of Time <br />• Planned Unit Development — Development Stage Plan <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND <br />On August 28, 2006 the City Council adopted Resolution No. 06 -137, approving the Planned <br />Unit Development - Development Stage Plan for a residential subdivision/conservation <br />development on the south end of Pheasant Run, approximately 1,300 feet south of Birch Street. <br />A Planned Unit Development — Development Stage Plan must be followed by the first phase's <br />PUD -Final Plan application within 12 months, and the applicant has not been able to meet this <br />deadline. For record keeping purposes, staff is recommending April 31, 2009 as the new <br />deadline for submittal of the final plan. <br />The development's escrow account for the PUD - Development Stage Plan was converted to a <br />long term escrow account with the grading only development agreement approved by the City <br />Council in 2007. A full final plan application will be required when the developer is ready to <br />proceed, which will include an escrow deposit per the city's fee schedule. <br />RECOMMENDATION <br />Staff is recommending adoption of Resolution No. 08 -106 approving an extension of the Planned <br />Unit Development — Development Stage Plan approval, subject to the following conditions: <br />1. The complete final plan application for The Preserve must be submitted by April 31, <br />2009. <br />2.
