MEETING DATE: March 14, 2011 <br />TOPIC: Consideration of Resolution No. 11 -30 <br />Extension of Time for The Preserve <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />In 2006 the City Council approved The Preserve, a residential subdivision. This approval <br />included Ordinance 08 -06, a Rezone to Planned Unit Development (PUD); and Resolution 06- <br />137 approving a PUD Development Stage Plan/Preliminary Plat <br />A PUD Development Stage Plan must be followed by the Final Plan application within twelve <br />months under the zoning ordinance. Likewise, a final plat must be submitted within one year of <br />the preliminary plat approval under the subdivision regulations. The project did not meet these <br />deadlines due to the widespread slowdown in development in the region. The City extended the <br />deadline with Resolutions 08 -109, 09 -77, 10 -34, and 10 -86. The recommendation is to extend <br />• the PUD final plan/final plat deadline again. <br />We did receive a final plat application though there are some pieces of information still lacking. <br />Staff did bring it to the Planning & Zoning Board, which gave a recommendation based on <br />receiving the missing pieces. All incomplete and missing elements must be submitted before the <br />application is complete and the final plat is brought to the City Council for approval. <br />The preservation of open space on this site will be an important step in the implementation of the <br />City's larger greenway vision. The Preserve site includes a high value natural resource area that <br />includes a major drainage through the southern part of Lino Lakes. Permanent open space is to <br />be created behind most lots that extends for hundreds of feet. These areas are to be placed in a <br />permanent conservation easement. The approval included a restoration and management plan for <br />wetlands and other open space. A public trail also would be created. <br />OPTIONS <br />1. Approve Resolution No. 11 -30 granting an extension for submitting the PUD -Final <br />Plan/Final Plat. <br />2. Deny Resolution No. 11 -30. <br />3. Return to staff with direction. <br />• <br />
