MEETING DATE: June 27, 2011 <br />TOPIC: Resolution No. 11 -71: Approving Two Agreements With <br />Eagle Brook Church Required for Parking Lot Expansion <br />• Site Improvement Performance Agreement <br />• Operation and Maintenance Agreement for Stormwater <br />Treatment Features <br />ACTION: 3/5 vote <br />BACKGROUND <br />Eagle Brook Church submitted a site plan application for expanding the parking lot on its site at <br />7775 20th Ave. The plan includes expanding the existing parking lot on the south side of the <br />existing building. The parking expansion is not a new idea. It was discussed as being needed in <br />the future for additional seating and included in the analysis conducted for an Environmental <br />Assessment Worksheet. Therefore, the expansion will have no unforeseen environmental <br />impacts. The increase in seating, which would require amending the conditional use permit, is <br />not occurring at this time. <br />Nonetheless, to ensure that all issues are covered at the necessary level of detail, the parking <br />expansion was addressed with a site and building plan review. Site and building plan reviews <br />are conducted administratively in accordance with Section 3, Subd. 6 of the Zoning Ordinance. <br />Staff approval, with conditions, was granted on May 20. The conditions include the preparation <br />of two documents. <br />The City requires a site improvement performance agreement when a project requires a site plan <br />review. This agreement ensures that fundamental work on the site is completed by requiring an <br />escrow deposit. A new site improvement performance agreement has been prepared because the <br />original agreement did not include the new parking expansion. <br />In addition, a maintenance agreement for stormwater facilities often is needed on projects that <br />create new stormwater facilities. Poorly functioning stormwater facilities pose flooding and <br />water quality problems for other properties and water bodies. The parking expansion requires <br />some additional stormwater facilities that were not included in the previous stormwater <br />agreement. <br />We have worked with Eagle Brook Church to prepare the two documents. Resolution No. 11 -71 <br />approves both new documents. <br />
