Wedel, City Engineer <br />October 24, 2011 <br />Consider Resolution No. 11 -105 Authorizing the Certification <br />of Expenses Incurred in Carrying Out and Enforcing the <br />Hazardous Building Proceeding against 745 Oak Lane for <br />collection with 2011 Property Taxes Payable in 2012 <br />3/5 Vote Required <br />Resolution No. 08 -71 ordered the Removal of Hazardous Structures at 745 Oak Lane. <br />That resolution further ordered that unless action is taken by the property owner to <br />remove the hazardous structure the City would seek a Judgment for Enforcement of the <br />resolution. The property owner did not take action after notification of the requirements of <br />Resolution No. 08 -71. <br />Resolution No. 10 -104 adopted the expense report for costs incurred with hazardous <br />40 buildings at 745 Oak Lane. This resolution identified the costs incurred to be $16,616.33 <br />and was adopted by the City Council on November 22, 2010. Since it was too late in the <br />year to certify the assessments at that point, the certification rolled into 2011. <br />On March 10, 2011 the property owner for 745 Oak Lane was notified by letter from the <br />City Attorney that the costs incurred were $16,616.33 and requested payment. The <br />property owner was also notified that if payment was not received the full amount due <br />would be assessed against the property and collected with the property taxes. <br />Staff recommends that the City Council adopt Resolution No. 11 -105 authorizing the <br />certification of expenses incurred in carrying out and enforcing the hazardous building <br />proceeding against 745 Oak Lane to be collected with 2011 property taxes payable in <br />2012 at an interest rate of 8% per annum. <br />RECOMMENDATION <br />Approve Resolution 11 -105, authorizing the certification of costs of expenses incurred in <br />carrying out and enforcing the hazardous building proceeding against 745 Oak Lane for <br />collection with 2011 property taxes payable in 2012 <br />• <br />
