MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND <br />AGENDA ITEM 6.E.ii <br />Paul Bengtson <br />July 11, 2005 <br />Consideration of Resolution No. 05 -91: <br />Approving Russian Baptist Church <br />Site Improvement Performance Agreement <br />Simple Majority <br />The City Council has approved the Site and Building Plans and Conditional Use Permit <br />for the Russian Baptist Church, with conditions, per Resolution No. 02 -82 on September <br />23, 2002. The approval was then extended by Resolution 03 -148 on September 8, 2003, <br />and Resolution. On the same agenda (Item 6.E.i) another extension of time (Resolution <br />05 -90) is being requested by the church, and has been recommended for approval by <br />staff. <br />In accordance with the Site and Building Plan approvals, staff has prepared a Site <br />Improvement Performance Agreement. The agreement provides for the following: <br />1. Submittal by the developer of a Letter of Credit representing thirty -five (35) <br />percent of the site improvement costs to insure completion of the project in <br />accordance with the approved plans. <br />2. Deposit of a cash escrow to reimburse the City for costs incurred by the city <br />related to the development and improvement of the site and developer <br />improvements. <br />A previous Performance Agreement was approved by the City Council with Resolution <br />03 -80 on June 9, 2003. Attached to this report is an updated version of the Performance <br />Agreement. The developer has reviewed the agreement and is aware of the conditions set <br />forth. <br />RECOMMENDATION <br />Staff is recommending approval of Resolution No. 03 -80 approving the Site <br />Improvement Performance Agreement. <br />ATTACHMENTS <br />1.
