• <br />• <br />• <br />Cavegn Estates <br />Page 7 <br />CITY OF LINO LAKES <br />RESOLUTION NO. 05 -108 <br />RESOLUTION APPROVING THE PRELIMINARY PLAT AND ALLOCATION OF 1.38 <br />ACRES OF M.U.S.A. FOR CAVEGN ESTATES <br />WHEREAS, the City has received an application for preliminary plat and allocation of MUSA approval <br />for property currently described to -wit: <br />Lot 1, Block 2, Mar Don Acres <br />WHEREAS, the applicant is proposing to subdivide the property into two parcels described as Lots 1 and <br />2, Block 1, Cavegn Estates; and <br />WHEREAS, the preliminary plat and allocation of MUSA approval request is based on the following <br />submittals: <br />• Preliminary Plat received May 9, 2005. <br />; and <br />WHEREAS, at their meeting on July 13, 2005, the Planning & Zoning Board conducted a public hearing <br />and recommended approval of the preliminary plat and the allocation of MUSA subject to the conditions <br />listed in the meeting minutes; and <br />WHEREAS, the proposed preliminary plat and allocation of MUSA meets the requirements of the City's <br />zoning ordinance and subdivision ordinance subject to certain conditions of approval. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby approves the <br />preliminary plat and the allocation of MUSA for Cavegn Estates subject to the following conditions: <br />7. Both lots shall connect to city sanitary sewer and water, assessments for both lots will be recorded <br />with the final plat. <br />8. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />9. Park dedication shall be paid in accordance with city policies. <br />10. A vacation of the excess right of way and easements must be approved by the City Council prior <br />to the recordation of a final plat for the property. <br />11. The property can not be platted until 2006. <br />12. The standards of Section 3.Subdivision 4.D.8 regarding accessory structures must be met on both <br />lots created by the proposed plat. <br />
