• <br />• <br />• <br />Development Contract <br />Foxborough <br />August 22, 2005 <br />a) A homeowners association shall be created. The association shall <br />maintain a stewardship fund to manage the open space areas of <br />Outlots A, B, and C, according to a stewardship plan to be approved <br />by the City. Association documents shall be reviewed by the City <br />Attorney prior to final plat approval. <br />b) A conservation easement shall be created over all of Outlots A, B, <br />and C to make them permanent open space. <br />c) Review and approval of informational brochure including Best <br />Management Practices with regard to buffer and wetland area <br />requirements. <br />d) Receipt of warranty deeds or dedication of all outlots proposed to be <br />conveyed to the City. <br />e) Approved Restoration and Management Plan for Conservation <br />Areas, including the establishment of a $100,000 Conservation <br />Stewardship Fund. <br />XIII. VIOLATIONSBUILDING PERMITS <br />A. In the event that Developer violates any of the covenants and agreements contained <br />in this Development Contract and to be performed by the Developer, the City, at its <br />option, in addition to the rights and remedies as set out hereunder may refuse to <br />issue building permits and/or Certificate of Occupancies to any property within the <br />Subdivision until such time as such default has been corrected to the satisfaction of <br />the City. <br />XIV. PARK DEDICATION <br />A. The Developer shall dedicate the 20 -foot wide park land for the trail system. The <br />Developer shall be responsible for the construction of a 10 -foot wide trail system <br />including three (3) l0 -foot wide boardwalks. This dedication and construction of <br />the trail system fulfills the Developer's Park Dedication requirements. <br />XV. PROPERTY TAXES <br />A. Should the recording of the Final Plat occur after July 1, any and all property taxes <br />on any public property dedicated as a part of this plat shall be the responsibility of <br />the Developer. Dollars shall be incorporated into the escrow agreement to cover the <br />cost of said property taxes. <br />page 13 <br />
