• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 05-140 <br />RESOLUTION AGREEING TO METROPOLITAN COUNCIL <br />CONDITIONS FOR PAYMENT OF $450,000 LIVABLE COMMUNITIES ACT <br />(LCA) DEMONSTRATION ACCOUNT GRANT <br />WHEREAS, In December of 2000, the Metropolitan Council awarded the City of <br />Lino Lakes a $450,000 Livable Communities Act (LCA) Demonstration Grant; <br />and <br />WHEREAS, the grant was contingent, in part, on the condition that the City of <br />Lino Lakes install a traffic signal on the northbound off -ramp of I -35W; and <br />WHEREAS, improvements to Lake Drive (CSAH 23), including signalization of <br />the I -35W ramps, are included in the approvals, development contract, and <br />financing plan for the City's mixed use Legacy at Woods Edge project; and <br />WHEREAS, the City has authorized the final design for improvements to Lake <br />Drive, including the signalization of the northbound off -ramp of I -35W; and <br />• WHEREAS, the improvements are scheduled for construction in 2006; and <br />WHEREAS, Metropolitan Council has requested that the City agree to reimburse <br />the Council by January 31, 2008 if the signals are not operational by December <br />31, 2007 as a condition of releasing the LCA grant funding prior to installation of <br />the signal system <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LINO LAKES, MINNESOTA: <br />1. that the City agrees to the reimburse the Metropolitan Council by January <br />31, 2008 the entire $450,000 grant amount if a traffic signal is not installed <br />on the northbound off -ramp of I -35W and operational by December 31, <br />2007. <br />BE IT FURTHER RESOLVED BY THE CITY OF LINO LAKES, MINNESOTA: <br />1. that it be understood by Metropolitan Council, that while the City is <br />committed to this project, Anoka County has jurisdiction of County <br />State Aid Highway 23 (Lake Drive) and the Minnesota Department of <br />Transportation has jurisdiction of I -35W (including the ramps that need <br />to be realigned to signalize the intersection). <br />
