MEETING DATE: September 26, 2005 <br />TOPIC: Resolution 05 -144 <br />Authorizing Distribution of the Final AUAR <br />ACTION: 3/5 <br />BACKGROUND <br />The City has been working on the I -35E Corridor Alternative Urban Areawide Review <br />(AUAR) for over a year. We distributed the draft AUAR for comments. The 30 -day <br />comment period started on July 4, 2005 and ended on August 3, 2005. The City received <br />comment letters from a number of state agencies and local units of government as well as <br />some private parties. These are listed in the information distributed to the City Council <br />on September 16. <br />As required by Minnesota Rules, City staff and the AUAR consultant team has completed <br />the "Response to Comments" element of the Final AUAR, which provides responses to <br />substantive comments received. The Response to Comments document is included in the <br />meeting packet. Responding to the comment letters warranted revisions or additions to <br />Items 17 and 21 in the AUAR. <br />The Final AUAR document also includes a Mitigation Plan. The mitigation plan takes on <br />the nature of a commitment by the City to prevent potentially significant impacts from <br />occurring from specific projects within the AUAR area. <br />The Lino Lakes Environmental Board and AUAR Advisory Panel met on September 22, <br />2005 to review and comment on the city's Response to Draft AUAR Comments and the <br />Mitigation Plan. The City Council discussed the Final AUAR materials at its September <br />21, 2005 workshop. <br />The request before the City Council is to authorize distribution of the Final AUAR to <br />persons on the EQB's distribution list as well as to any persons who commented on the <br />Draft AUAR. State agencies and the Metropolitan Council have ten days to file an <br />objection to the Final AUAR. If no objections are filed, then the City Council is required <br />to adopt the Final AUAR. <br />
