Rehbein Amendment <br />Page 4 of 5 <br />Council Memberear'son introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 06-72 <br />RESOLUTION APPROVING AMENDMENT OF AN EXISTING CONDITIONAL USE <br />PERMIT TO ALLOW A BUILDING ADDITION AT REHBEIN TRANSIT, 6298 <br />HODGSON ROAD. <br />WHEREAS, Rehbein Transit has submitted a request to the City to amend an existing <br />conditional use permit to allow for a building addition at 6298 Hodgson Road, and <br />WHEREAS, the legal description of the property is: <br />That part of the southeast quarter of the northeast quarter of Section 31 Township 31 <br />Range 22 lying west of the east 517 feet thereof and north of that part platted as Fox <br />Trace, excluding road, and subject to easement of record. <br />and <br />'WHEREAS, the City's review is based on the Rehbein Transit Plan Set received March 14, <br />2005; <br />WHEREAS, the Planning Commission held a public hearing on the application on April 13, <br />2005, and recommended approval with conditions, and <br />WHEAREAS, the City Council of the City of Lino Lakes approved the original Conditional Use <br />Permit on May 22, 1995, and <br />WHEREAS, the City Council of the City of Lino Lakes finds that, with the conditions of <br />approval included in this resolution, the following findings of fact apply as required by Section 2 <br />Subd. 2.B.7 and by Section 8 Subd.2.I.4 of the zoning ordinance: <br />a. This application is consistent with the comprehensive plan, including future and present <br />land uses. The building additions do not alter existing uses on the site. <br />b. The application meets all performance standards. <br />c. The project will not increase traffic generation or impacts. <br />d. The project will not increase demands on sanitary sewer and water use. <br />e. The project will not require capital improvements by the City. <br />f. The project will not create detrimental impacts. <br />g. The project will not impact natural or historic features. <br />h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met. <br />i. The project will not alter the site's drainage system previously approved by the City <br />Engineer. <br />-58- <br />
