• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1H <br />Julie Bartell, City Clerk <br />June 26, 2006 <br />Consider Resolution No. 06 -99, Approving an <br />Application for a Temporary 3.2 Percent Malt <br />Liquor (Beer) License, a Cabaret License and an <br />Exemption for Gambling Permit for the Annual <br />St. Joseph Catholic Church August Festival <br />Simple Majority (3/5 Vote Required) <br />St. Joseph Church is hosting its annual August Festival on Saturday, August 12 and <br />Sunday, August 13, 2006. As part of the celebration, food and beverages, including <br />• beer, will be served. The Lino Lakes City Code, Section 702.02, Subdivision 3, states <br />"temporary on -sale licenses shall be granted only to bona fide clubs and charitable, <br />religious and non - profit organizations for the sale of beer for consumption on the <br />premises only." <br />In addition, the parish has made application to acquire a cabaret license and approval <br />for an exemption for lawful gambling permit. A dance will be held on Saturday, <br />August 12, from 5:00 p.m. to 10:00 p.m. and Sunday, August 13 from 11:00 a.m. to 5:00 <br />p.m. Non - profit organizations are allowed under State gambling laws to apply for an <br />exemption permit if they conduct fewer than five (5) gambling occasions per year. <br />St. Joseph Catholic Church conducts fewer than five. <br />St. Joseph's has completed the necessary, applications, submitted a current certificate <br />of insurance and paid the proper fees. The applications and the certificate of insurance <br />are on file in the office of the City Clerk. <br />The police department conducted a background investigation and found no reason to <br />deny approval. <br />OPTIONS: <br />1.
