• • Council Member Reinert introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION 06 -137 APPROVING PUD DEVELOPMENT STAGE PLAN/PRELIMINARY PLAT AND ALLOCATION OF MUSA RESERVEFOR THE PRESERVE WHEREAS, the Lino Lakes City Council makes the following findings: Findings 1. Integra Homes has submitted an application for a residential planned unit development (PUD) and a development stage plan/preliminary plat for the PUD. 2. The site includes approximately 53 acres. 3. The comprehensive plan guides the part of the site to be built on for Low Density Sewered Residential land use and it is within the Stage 1 (pre -2010) growth area. 4. Ordinance No. 08 -06 rezones the site from R -1, Single Family Residential and Rural to Residential Planned Unit Development. 5. The Preserve project is a conservation development. 6. The Planning & Zoning Board opened a public hearing on the application on May 10 and closed the hearing on June 14, 2006. NOW, THEREFORE, BE IT RESOLVED that the Lino Lakes City Council hereby approves the application for a planned unit development development stage plan/preliminary plat for The Preserve. BE IT FURTHER RESOLVED that the City Council allocates 3 (three) acres of MUSA reserve for the project. BE IT FURTHER RESOLVED that the following conditions of approval shall apply: 1. Some lots will have restricted back yards due to easements or other features of the development plat. The developer, builders, and future property owners should be aware of this. House structures shall only be built within the building pads on the approved plans.
