Council Member Stoltz introduced the following resolution and moved its <br />110 adoption: <br />CITY OF LINO LAKES <br />COUNTY OF ANOKA <br />RESOLUTION NO. 06 -139 <br />RESOLUTION APPROVING CITY OF LINO LAKES <br />RIGHT OF WAY PLAT NO. 3 <br />(LAKE DRIVE /I -35W INTERCHANGE) <br />WHEREAS, the City of Lino Lakes, Minnesota is proposing to undertake the <br />reconstruction of the Lake Drive (CSAH 23)/I -35W interchange; and <br />WHEREAS, the proposed project will require the acquisition of certain properties <br />to facilitate the roadway improvements; and <br />WHEREAS, the City's Engineering Consultant has prepared a plat outlining all <br />tracts and parcels of land affected by the proposed acquisition in accordance <br />with Minnesota Statutes 505.1793. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />• OF LINO LAKES, MINNESOTA: <br />1. That City of Lino Lakes Right -of -Way Plat No. 3 is hereby approved. <br />2. The Mayor and City Clerk are hereby authorized to execute said plat on <br />behalf of the City. <br />Adopted by the Council of the City of Lino Lakes this 28th day of August, 2006. <br />• <br />Juli nne Bartell City lerk <br />The motion for the adoption of the foregoing resolution was duly seconded by <br />Council Member ODonnelland upon vote being taken thereon, the following <br />voted in favor thereof: <br />Stoltz, O'Donnell, Reinert, Carlson, Bergeson <br />The following voted against same: <br />John Bergeson, Mayor <br />
