Council Membercaonnei introduced the following resolution and moved its adoption: <br />• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 06 -145 <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW A DOG KENNEL AT <br />575 ASH STREET. <br />WHEREAS, Margo Polta has submitted a request to the City to grant a conditional use permit to allow for a <br />private dog kennel at 575 Ash Street, and <br />WHEREAS, the legal description of the property is: <br />The east 20 acres of the southeast quarter of the southwest quarter of Section 32 Township 31 Range 22; <br />excluding the east 330 feet thereof, also excluding the road; subject to easements of record. <br />and <br />WHEREAS, the City's review is based on the Plan Set received May 12, 2006; <br />WHEREAS, the Planning Commission held a public hearing on the application on July 12, 2006, and <br />recommended approval with conditions, and <br />EREAS, the City Council of the City of Lino Lakes finds that, with the conditions of approval included in <br />this resolution, the following findings of fact apply as required by Section 2 Subd. 2.B.7 and by Section 8 <br />Subd.2.I.4 of the zoning ordinance: <br />a. This application is consistent with the comprehensive plan, including future and present land uses. <br />b. The application meets all performance standards. <br />c. The project will not increase traffic generation or impacts. <br />d. The project will not increase demands on sanitary sewer and water use. <br />e. The project will not require capital improvements by the City. <br />f. The project will not create detrimental impacts. <br />g. The project will not impact natural or historic features. <br />h. All applicable Minnesota Pollution Control Agency requirements are satisfactorily met. <br />i. The project will not alter the site's drainage system. <br />NOW, THEREFORE, BE IT RESOLVED, that the Lino Lakes City Council hereby approves a conditional use <br />permit to allow a private kennel as depicted on the submitted plans. <br />BE IT FURTHER RESOLVED that the following conditions apply: <br />6. Ongoing compliance with Sections 502 and 503 and 607 of the City Code. <br />At no time shall dogs that are not owned by the occupant of the dwelling be allowed to remain on the <br />property overnight. <br />8. A maximum of three dogs over the age of six months shall be kept on the property at any one time. <br />-57- <br />
