• factors, and granting these variances for are in keeping with the spirit and intent <br />• <br />• <br />of the ordinance <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby <br />approves the preliminary plat and MUSA allocation for Golden Acre with conditions. <br />BE IT FURTHER RESOLVED that a variance for the lot depth of all four lots, the lot <br />width and area for Lot 2 Block 1, and the side setback for Lot 1 Block 1 are hereby <br />approved to allow the lots as shown on the preliminary plat. <br />BE IT FURTHER RESOLVED that the following conditions of approval apply: <br />1. All lots in the plat, including the existing home, must agree to connect to City <br />utilities. The City will not approve the final plat without legally enforceable <br />assurance that all properties will connect and existing onsite septic systems will <br />be appropriately abandoned. <br />2. Existing wells shall be capped when required by Minnesota Dept. of Health <br />requirements. <br />3. Issues discussed in the City Engineer review memo must be addressed to his <br />satisfaction. <br />4. A development agreement between the city and the developer must be executed <br />prior to the issuance of any building permits for the site. <br />5. The north 30 feet shall be dedicated to the City on the final plat for right of way <br />for Arlo Lane. <br />6. Park dedication must be paid in accordance with the city's fee schedule. <br />7. A permit from the Rice Creek Watershed District must be issued prior to final plat <br />approval by the City. <br />8. Infiltration areas proposed on site should have the City native seed specification <br />used. <br />9. A boulevard tree shall be provided for each lot frontage unless the city forester <br />approves the substitution of a preservation -worthy tree that exists on the site. <br />10. A tree inventory and preservation plan must be submitted to the city prior to any <br />construction on the site. <br />11.
