AGENDA ITEM 3B <br />• STAFF ORIGNINATOR: Gordon Heitke, City Administrator <br />MEETING DATE: December 11, 2011 <br />TOPIC: Resolution No. 06 -197 Authorizing a Joint Powers Agreement for Vadnais Lake Area Water <br />Management Organization <br />VOTE REQUIRED: 3/5 <br />BACKGROUND <br />The Vadnais Lake Area Water Management Organization ( VLAWMO) was established in 1983 to meet <br />the requirements of the Metropolitan Surface Water Management Act and originally consisted of five <br />cities, a township, and the St. Paul Regional Water Service / Board of Water Commissioners. VLAWMO <br />acts as the Local Government Unity (LGU) in the administration of the Wetland Conservation Act for the <br />six government entities and promotes preservation of natural surface and ground water systems. Since its <br />inception in 1983 the organization has reviewed development plans to ensure compliance with the <br />Wetland Conservation Act, promoted public education programs, sponsored ongoing water quality testing <br />programs and worked with other agencies to resolve wetland impact issues. The current Joint Powers <br />Agreement, which authorizes VLAWMO to act for the member government units, is set to expire on <br />January 1, 2007. <br />• Representatives of the member units of government have drafted a new Joint Powers Agreement which <br />• <br />would be effective through the year 2011. Significant changes to the new agreement include: <br />1. Creation of a Board of Directors comprised of elected officials from member government <br />units. <br />2. Creation of a Technical Committee consisting of representatives appointed by member units to <br />provide technical expertise and guidance for the planning and operations of VLAWMO. <br />3. Budget preparation schedule is coordinated with the budget schedules of the municipal <br />members. <br />4. Membership will not include the St. Paul Regional Water Service / Board of Water <br />Commissioners. <br />The source of revenue for the operating budget will initially continue to rely on annual payments from the <br />general funds of member units; however, other members have indicated their intention of pursuing levy <br />authority for VLAWMO in order for there to be equitable means within their jurisdictions of funding <br />watershed districts and VLAWMO. <br />RECOMMENDATION <br />Staff is recommending the approval of Resolution No. 06 -197 Authorizing a Joint Powers Agreement for <br />Vadnais Lake Area Water Management Organization. <br />—57a- <br />
