RESOLUTION NO. 6r- b' <br />DECLARING A TEMPORARY MORATORIUM ON NEW CONSTRUCTION, SUBSTANTIAL IMPROVEMENTS AND <br />OTHER DEVELOPMENT IN AREAS OF SPECIAL FLOOD HAZARD IN THE City of Lino Lakes <br />Whereas, the City of Lino Lakes has been notified by the Federal Insurance <br />Administration that it's eligibility for participation in the National Flood <br />Insurance Program may be suspended if satifactory flood plain management measures <br />are not enacted by the City of Lino Lakes and <br />Whereas, a temporary moratorium on new construction, substantial improvement, and <br />other development in areas of special flood hazard will suffice to extend the City of <br />Lino Lakes eligibility in the National Flood Insurance Program through the term of <br />the moratorium, and <br />Whereas, the City of Lino Lakes acknowledges that it's eligibility for participation <br />in the National Flood Insurance Program may be suspended at the expiration of this <br />moratorium ifflood plain management measures meeting the standards of Section 60.3 (d) <br />of the program regulations (24 VFR 1909, etc.) are not enacted. <br />NOW THEREFORE, BE IT RESOLVED BY THE <br />Section 1 - That new construction, substantial improvement, and other development <br />in areas of special flood hazard in the City of Lino Lakes identified by the <br />Federal Insurance Administration in a scientific and engineering report entitled: <br />III"The Flood Insurance Study for the City of Lino Lakes ", dated 5/17/82, with <br />accompanying flood insurance rate maps and flood boundary - floodway maps shall not be <br />permitted prior to August 17, 1982. <br />Section 2 - That the building department shall be formally instructed by the City <br />Council that no permits for new construction, substantial improvement, and other <br />development shall be issued within Federal Insurance Administration designated areas <br />of special flood hazard prior to August 17, 1982 "Development" means any manmade <br />change to improved or unimproved real estate, including but not limited to buildings <br />or other structures, mining, dredging, filling, grading, paving, excavation or <br />drilling operations. <br />Section 3 - That this resolution shall take effect and be enforced immediately <br />after it's passage and approval. <br />Passed this /O <br />ATTEST: <br />)11 <br />tio? ✓t , — <br />• <br />
