• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 12 -30 <br />APPROVING JOINT POWERS AGREEMENT FOR THE INTERSECTION <br />RECONSTRUCTION OF COUNTY STATE AID HIGHWAY 34 (BIRCH STREET) AND <br />WARE ROAD <br />WHEREAS, the City of Lino Lakes and the County of Anoka agree it is in the best interest <br />of the traveling public to reconstruct the intersection of County State Aid Highway 34 (Birch Street) <br />and Ware Road; and <br />WHEREAS, the City has prepared preliminary design plans for the reconstruction of the <br />intersection of County State Aid Highway 34 and Ware Road in accordance with Anoka County and <br />the Minnesota Department of Transportation standards to a staff approved layout conditions; and <br />WHEREAS, Anoka County has jurisdiction over County State Aid Highway 34; and <br />WHEREAS, the parties agree that it is in their best interest that the cost of said project be <br />shared; and <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter into <br />joint powers agreements for the joint exercise of powers common to each. <br />NOW, THEREFORE, BE IT RESOLVED by The City Council of The City of Lino Lakes, <br />Minnesota: <br />1. That the Joint Powers Agreement with Anoka County to reconstruct the intersection of <br />County State Aid Highway 34 (Birch Street) and Ware Road is hereby approved and <br />authorizes the Mayor and City Clerk to sign the Agreement. <br />Adopted by the Council of the City of Lino Lakes this 26thday of March, 2012. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />O' Donnell and was duly seconded by Council Member Roeser and upon vote being <br />taken thereon, the following voted in favor thereof: <br />O'Donnell, Roeser, Rafferty, Stoesz, Reinert <br />The following voted against same: <br />none <br />ATTEST: <br />� 1 <br />Julie Bartell, City lerk <br />Jeff Reine , Mayor <br />
