STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />INTRODUCTION <br />CITY COUNCIL <br />AGENDA ITEM 1G <br />Julie Bartell, City Clerk <br />June 25, 2012 <br />Resolution No. 12 -49, Approving an Application <br />for a Temporary On -Sale Liquor License, a Cabaret <br />License, and an Exemption for Gambling Permit for <br />the Annual St. Joseph's Catholic Church August Festival <br />3/5 <br />St. Joseph Church is hosting its annual August Festival on Saturday, August 11 and Sunday, <br />August 12, 2012. <br />BACKGROUND <br />As part of the festival, food and beverages including strong beer and wine will be served. <br />Although temporary on -sale liquor licenses are issued by the Minnesota Department of Public <br />Safety, local approval is required. Staff has verified that St. Joseph's Church is eligible under <br />local ordinance for a temporary license. <br />The Church has also made application to acquire a cabaret license. Bands will be playing live <br />music in the church parking lot on Saturday from 5:00 p.m. to 11:00 p.m. and Sunday from <br />1:00 to 5:00 p.m. <br />The Church has also applied for an Exempt Permit to allow charitable gambling. Non- profit <br />organizations are allowed under State gambling laws to apply for an exempt permit if they <br />conduct fewer than five (5) gambling occasions per year. St. Joseph Catholic Church conducts <br />fewer than five. <br />St. Joseph's has completed the necessary applications, has submitted a current certificate of <br />insurance and has paid the proper fees. The applications and the certificate of insurance are <br />filed in the office of the City Clerk. Staff conducted a background investigation and found no <br />reason to deny the licensing requests. <br />RECOMMENDATION <br />Approval of Resolution No. 12 -49, Approving an Application for a Temporary On -Sale Liquor <br />License, a Cabaret License, and an Exemption for Gambling Permit for the Annual St. Joseph's <br />110 Catholic Church August Festival. <br />
