• <br />• <br />CITY COUNCIL <br />AGENDA ITEM 6C <br />STAFF ORIGINATOR: Michael Grochala <br />MEETING DATE: June 25, 2012 <br />TOPIC: Consider Resolution No. 12 -58, Ordering <br />Improvement, Otter Lake Road Extension <br />VOTE REQUIRED: Simple Majority <br />INTRODUCTION <br />The public hearing for the Otter Lake Road improvement project was held on February 13, 2012. <br />Minnesota Statutes, Chapter 429, requires that a resolution ordering the improvement be adopted <br />by the City Council within 6 months of the date of the public hearing. Alternatively, the Council <br />would need to restart the public improvement process including repetition of the notice and <br />hearing requirements. <br />Staff is requesting council action to order the improvement for procedural purposes. <br />BACKGROUND <br />On May 23, 2011 the City Council authorized preparation of a feasibility study for the proposed <br />improvements. The study was received by the Council on January 9, 2012. A public hearing on <br />the proposed improvements was held on February 13, 2012. The Council took action at the <br />February 27, 2012 meeting to authorize the preparation of a special benefit study and land <br />acquisition appraisals. On March 12, 2012 the Council approved Resolution No. 12 -27 <br />authorizing preparation of plans and specifications. <br />RECOMMENDATION <br />Staff is recommending approval of Resolution No. 12 -58 Ordering the Improvement. Approval <br />of the resolution does not commit the City to constructing the project. The Council will still <br />need to take action to approve plans and specifications, order advertisement for bids, award a <br />contract and acquire property before the project could commence. At any point in this process <br />the Council may determine to terminate the project. <br />ATTACHMENTS <br />1. Resolution No. 12 -58 <br />
