• <br />CITY COUNCIL <br />AGENDA ITEM lE <br />STAFF ORIGINATOR: Michael Grochala <br />MEETING DATE: August 27, 2012 <br />TOPIC: Consideration of Resolution No. 12 -87 <br />Extension of Time for The Preserve <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />In 2006 the City Council approved The Preserve, a residential subdivision. This approval <br />included Ordinance 08 -06, a Rezone to Planned Unit Development (PUD) and Resolution 06- <br />137 approving a PUD Development Stage Plan/Preliminary Plat. The site has not been <br />developed, but the owner is still interested in pursuing the project. <br />BACKGROUND <br />• A PUD Development Stage Plan must be followed by the Final Plan application within twelve <br />months under the zoning ordinance. Likewise, a final plat must be submitted within one year of <br />the preliminary plat approval under the subdivision regulations. The City extended the deadline <br />with Resolutions 08 -109, 09 -77, 10 -34, 10 -86, 11 -30, 11 -85 and 12 -14. <br />• <br />The project has not met these deadlines due to the widespread slowdown of development in the <br />region. The current submittal deadline is October 1, 2012, and the recommendation is to extend <br />it to April 1, 2013. <br />Preservation of open space on this site is an important step for implementing the City's larger <br />greenway vision. The site includes a high value natural resource area. Permanent open space <br />behind most lots extends for hundreds of feet and will be in a permanent conservation easement. <br />The approval included a restoration and management plan for wetlands and other open space. <br />RECOMMENDATION <br />Approve Resolution No. 12 -87 granting an extension for submitting the PUD -Final Plan/Final <br />Plat. <br />ATTACHMENTS <br />1.
