• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 12 -117 <br />RESOLUTION ORDERING IMPROVEMENT <br />OTTER LAKE ROAD EXTENSION <br />WHEREAS, pursuant to Resolution No. 12 -58 adopted the 25th day of June, 2012, the City <br />Council ordered the improvement of Otter Lake Road between Main Street and a point <br />approximately 440 feet northerly of Main Street by street construction and installation of sanitary <br />sewer, water main, storm sewer, traffic control signals and pedestrian/bicycle facilities, and <br />WHEREAS, the City Council has authorized the preparation of plans and specifications; and <br />WHEREAS, the construction of the project will require the acquisition of various lands and <br />easements; and <br />WHEREAS, the City of Lino Lakes, a Minnesota municipal corporation, acting by and through <br />the City Council, is authorized by law to acquire real estate which is needed for public use or <br />purpose; and <br />WHEREAS, the Project's construction schedule contemplates that work will begin in the spring <br />of 2013; and <br />WHEREAS, it is necessary that the City have title and possession to the necessary right of way <br />• interest for the Project before the construction contracts may be let. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. City representatives, City Community Development Director and City Attorney are hereby <br />authorized to make offers and negotiate the acquisition of land and easements necessary for <br />the making of the improvement in accordance with Exhibit A, attached hereto and made <br />apart hereof. <br />Adopted by the Council of the City of Lino Lakes this 26 day of Nov , 2012. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member Stoesz and <br />upon vote being taken thereon, the following voted in favor thereof: <br />Rafferty, Stoesz, O'Donnell, Roeser, Reinert <br />The following voted against same: <br />none <br />• <br />Jeff Rein rt . ror <br />
