CITY OF LINO LAKES• <br /> RESOLUTION NO. 12-130 <br /> RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW <br /> A MOTOR FUEL STATION AT THE PROPERTY LOCATED ON THE NORTHEAST <br /> CORNER OF LAKE DRIVE AND MAIN STREET <br /> WHEREAS, Grant Rademacher has submitted a request to the City for a conditional use permit <br /> to allow for the construction of a motor fuel station(Bill's Superette) located on the property <br /> located on the northeast corner of Lake Drive and Main Street; and <br /> WHEREAS,the legal description of the property(Subject Property) is: <br /> All of Lots 5, 6 and 7, Forest View Acres and those parts of the vacated service road and Lot 1, <br /> Forest View Acres, lying South of the North line of Lot 5 extended Westerly to the highway <br /> right of way,Anoka County, Minnesota and lying southeasterly of the northwesterly 30 feet of <br /> said Lot 1; and <br /> WHEREAS, staff has prepared a review of the plan set, dated September 7, 2012, most recently <br /> revised November 7, 2012; and <br /> WHEREAS,the Planning and Zoning Board held a public hearing on November 14, 2012 and <br /> unanimously recommended approval with conditions; and <br /> WHEREAS,the City Council of the City of Lino Lakes makes the following findings: <br /> a. The proposed development application has been found to be consistent with the policies <br /> and recommendations of the Lino Lakes Comprehensive Plan. <br /> b. The proposed development application is compatible with present and future land uses of <br /> the area. <br /> c. The proposed development application conforms to performance standards herein and <br /> other applicable City Codes subject to conditions of approval. <br /> d. Traffic generated by a proposed development application is within the capabilities of the <br /> City. <br /> e. The proposed use will not involve uses, activities,processes, materials, equipment and <br /> conditions of operation that will be detrimental to any persons,property, or the general <br /> welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. <br /> f. The proposed use will not result in the destruction, loss, or damage of a natural, scenic or <br /> historic feature of major importance. <br />
