• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 13 -56 <br />AMENDING RESOLUTION 06 -137 ENTITLED "APPROVING PUD DEVELOPMENT <br />STAGE PLAN/PRELIMINARY PLAT AND ALLOCATION OF MUSA RESERVE FOR <br />THE PRESERVE", PASSED AUGUST 28, 2006 <br />WHEREAS, the PUD Stage Plan/Preliminary Plat for The Preserve required the construction <br />and maintenance of rain gardens and; <br />WHEREAS, further detailed engineering and site design of the development determined the <br />construction of small individual rain gardens was not feasible for storm water management. <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes the <br />following be deleted from Resolution 06 -137: <br />"10. The homeowners association shall be responsible for maintenance of the rain gardens. This <br />requirement shall be included in the easement covenants and restrictions document and this shall <br />be included in the association documents." <br />Adopted by the Council of the City of Lino Lakes this l3 day of <br />, 2013. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />R0PSer and was duly seconded by Council Member 6° Ob Alt aI and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Roeser, O'Donnell, Rafferty, Stoesz, Reinert <br />The following voted against same: <br />none <br />A EST: <br />Juli nne Bartell, ity Clerk <br />Jeff Rei -rt, rayor <br />
