• <br />• <br />• <br />The project is a conservation development and a Restoration and Management Plan for <br />Conservation Areas shall be implemented. The final plat contains 31 single family lots and six <br />(6) outlots. <br />The PUD final plan/final plat for Preserve at Lino Lakes is consistent with the PUD <br />Development Stage /preliminary plat and meets the requirements of the City Subdivision and <br />Zoning Ordinance. The City Attorney has reviewed the Title Commitment. On March 13, <br />2013, the Planning & Zoning Board made recommendation to the City Council to approve the <br />PUD final plan/final plat. <br />The City Engineer has prepared the Development Agreement which provides for the submittal of <br />fees and securities to cover City review costs and ensure completion of the public and private <br />improvements in accordance with the approved plans. <br />One condition of Resolution 06 -137 approving the PUD Development Stage Plan/Preliminary <br />Plat required the homeowners association be responsible for maintenance of rain gardens. <br />Further detailed engineering and site design of the development determined the construction of <br />small individual rain gardens was not feasible or necessary for storm water management. <br />Resolution 06 -137 shall be amended to omit the maintenance of rain gardens. <br />RECOMMENDATION <br />Staff is recommending approval of the following items with conditions: <br />1. Resolution No. 13 -56 Amending Resolution 06 -137 Entitled "Approving PUD <br />Development Stage Plan/Preliminary Plat and Allocation of Musa Reserve for the <br />Preserve ", passed August 28, 2006 <br />2. Resolution No. 13 -57 Approving the Planned Unit Development -Final Plan/Final Plat for <br />Preserve at Lino Lakes <br />3.
