• <br />• <br />• <br />WHEREAS, at their meeting on March 13, 2013, the Planning & Zoning Board recommended <br />approval of the planned unit development — final plan/final plat subject to certain conditions of <br />approval; and <br />WHEREAS, the proposed planned unit development — final plan/final plat meets the <br />requirements of the City's zoning ordinance and subdivision ordinance, subject to certain <br />conditions of approval. <br />NOW, THEREFORE, BE IT RESOLVED by The City Council of The City of Lino Lakes <br />that the planned unit development — final plan/final plat for Preserve at Lino Lakes is hereby <br />approved subject to the following conditions: <br />1. The developer shall submit an executed development agreement and all documents, fees <br />and securities required therein prior to release of the signed Final Plat. <br />2. The developer shall record the plat within 90 days after the date of approval, otherwise <br />the approval of the final plat shall be considered void, unless the developer requests and <br />receives an extension from the City Council. <br />3. A revised Conservation Easement, Covenants & Restrictions (CECR) shall be submitted <br />to the City in recordable format. <br />4. Homeowners Association documents shall be submitted to the City in recordable format <br />including Bylaws and Articles of Incorporation. <br />5. A Grading Permit application shall be submitted and approved by City Staff prior to any <br />grading or site work. <br />6. A quit claim deed for conveyance of Outlot A to the City in recordable format shall be <br />submitted by the developer. <br />7. A Sign Permit including maintenance plan and easement agreement for any area <br />(subdivision) identification signs shall be submitted and approved by the City prior to <br />sign installation. <br />8. The "The Preserve Conservation Development; Restoration and Management Plan for <br />Conservation Areas" shall be revised and approved by City staff. <br />9. The "Preserve of Lino Lakes" development has protection areas for Tubercled Rein - <br />orchid, an endangered species, and Scirpus clintonii, a special concern bulrush. Scirpus <br />clintonii is soon to be placed on the endangered list. These areas are to be set aside and <br />protected from construction damage. <br />a. Orange fencing with appropriate signage must be placed at the boundaries of <br />these areas. <br />b. Signage must state no equipment or disturbances of any kind allowed in the <br />protection areas. <br />c. Attention to these areas must be discussed at preconstruction meetings, and <br />sufficient notice to appropriate city staff given of the commencement of grading <br />operations. <br />10. A temporary cul de sac easement on Pheasant Run is required. <br />11. Construction details for boardwalks shall be submitted to the City for approval. <br />12. All additional comments from City Engineer Letter dated May 1, 2013 shall be <br />addressed. <br />
