• <br />CITY COUNCIL <br />AGENDA ITEM lE <br />STAFF ORIGINATOR: Katie Larsen <br />MEETING DATE: September 9, 2013 <br />TOPIC: Consideration of Resolution No. 13 -94 <br />Extension of Time for Main Street Village <br />VOTE REQUIRED: 3/5 <br />INTRODUCTION <br />In February of 2008, the City Council approved the Main Street Village project, including: <br />• Conditional Use Permit for a Planned Unit Development (PUD) Development Stage <br />Plan/Preliminary Plat (Resolution No. 08 -17); and <br />• Conditional Use Permit for a Motor Fuel Station (Resolution 08 -18); and <br />• Conditional Use Permit for Commercial Car Wash (Resolution 08 -19) <br />0 The site has not been developed, but the owner is still interested in pursuing the project. <br />BACKGROUND <br />A PUD Development Stage Plan must be followed by the Final Plan application within twelve <br />months under the zoning ordinance. Likewise, a final plat must be submitted within one year of <br />the preliminary plat approval under the subdivision regulations. For a conditional use permit <br />(CUP), construction must begin within one year of approval. Extensions have been granted by <br />the City Council through Resolutions 09 -76, 10 -33, 10 -77, 11 -29, 11 -84, 12 -13, 12 -86 and 13- <br />31. A PUD can be extended in six months intervals under the zoning ordinance. The current <br />submittal deadline for the PUD and CUP's is October 1, 2013, and the recommendation is to <br />extend it to April 1, 2014. <br />When built, this project would provide new commercial tax revenue near the I -35E interchange. <br />However, the economic conditions of the real estate market have affected development timelines <br />nationally, regionally, and locally. <br />RECOMMENDATION <br />Approve Resolution No. 13 -94 granting extensions for submitting the PUD Final Plan/Final Plat <br />and for construction to begin on the motor fuel station and carwash for Main Street Village. <br />ATTACHMENTS <br />• 1.
