• DEVELOPMENT CONTRACT AIno Addition THIS AGREEMENT made this day of December, 2013, is by and between the City of Lino Lakes, whose address is 600 Town Center Parkway, Lino Lakes, Minnesota, 55014, a municipal corporation organized under the laws of the State of Minnesota, hereinafter referred to as the "City," and Richard J. Schreier, a single person whose address is 2125 Desoto Street, Maplewood, MN 55117, and ALino LLC, a Minnesota limited liability corporation whose address is 95 South Owasso Boulevard West, Little Canada, MN 55117 hereinafter referred to as the "Developer". WHEREAS, the Developer has received preliminary plat approval from the City Council for a plat of land within the corporate limits of the City known as Alino Addition hereinafter called "Subdivision," as shown in Attachment A and is legally described as follows: That part of the Northeast Quarter of the Northwest Quarter of Section 24, Township 31, Range 22, Anoka County, Minnesota lying westerly and northerly of ANOKA COUNTY HIGHWAY RIGHT -OF -WAY PLAT NO. 75, according to the recorded plat thereof, Anoka County, Minnesota. WHEREAS, the Developer is to be responsible for the installation and financing of certain public and improvements within the Subdivision; and WHEREAS, said public improvements include grading, drainage, sanitary sewer, water, storm sewer, and driveway (the "Improvements"); and WHEREAS, the Developer and the City have entered into a Petition and Waiver Agreement dated September 24, 2013 for the installation and financing of 21St Avenue from Main Street to their northerly property line; and WHEREAS, the City Subdivision Ordinance and Minnesota Statutes section 462.358 authorize the City to enter into a performance contract secured by cash escrow or other security to guarantee completion and payment of such improvements following final approval and recording of final plat. NOW, THEREFORE, in consideration of the mutual promises of the parties made herein,
