• <br />DEVELOPMENT CONTRACT <br />AIno Addition <br />THIS AGREEMENT made this day of December, 2013, is by and between <br />the City of Lino Lakes, whose address is 600 Town Center Parkway, Lino Lakes, Minnesota, <br />55014, a municipal corporation organized under the laws of the State of Minnesota, hereinafter <br />referred to as the "City," and Richard J. Schreier, a single person whose address is 2125 Desoto <br />Street, Maplewood, MN 55117, and ALino LLC, a Minnesota limited liability corporation <br />whose address is 95 South Owasso Boulevard West, Little Canada, MN 55117 hereinafter <br />referred to as the "Developer". <br />WHEREAS, the Developer has received preliminary plat approval from the City Council <br />for a plat of land within the corporate limits of the City known as Alino Addition hereinafter <br />called "Subdivision," as shown in Attachment A and is legally described as follows: <br />That part of the Northeast Quarter of the Northwest Quarter of Section 24, Township 31, <br />Range 22, Anoka County, Minnesota lying westerly and northerly of ANOKA COUNTY <br />HIGHWAY RIGHT -OF -WAY PLAT NO. 75, according to the recorded plat thereof, <br />Anoka County, Minnesota. <br />WHEREAS, the Developer is to be responsible for the installation and financing of <br />certain public and improvements within the Subdivision; and <br />WHEREAS, said public improvements include grading, drainage, sanitary sewer, water, <br />storm sewer, and driveway (the "Improvements"); and <br />WHEREAS, the Developer and the City have entered into a Petition and Waiver Agreement <br />dated September 24, 2013 for the installation and financing of 21St Avenue from Main Street to their <br />northerly property line; and <br />WHEREAS, the City Subdivision Ordinance and Minnesota Statutes section 462.358 <br />authorize the City to enter into a performance contract secured by cash escrow or other security <br />to guarantee completion and payment of such improvements following final approval and <br />recording of final plat. <br />NOW, THEREFORE, in consideration of the mutual promises of the parties made herein, <br />
