• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 13 -125 <br />Finding a Violation of the City Code and Imposing Penalty Against <br />The Tavern of Main <br />WHEREAS, the Police Department of Lino Lakes conducted a compliance check on August 28, <br />2013. At that time The Tavern on Main failed the compliance check. <br />WHEREAS, it was alleged that Miller's on Main violated the Lino Lakes Code of Ordinances, <br />Section 702, by selling beer to a person underage; <br />WHEREAS, the City Council of Lino Lakes conducted a violation hearing on November 25, <br />2013 at 6:15 p.m. and reached a finding that a violation did occur; <br />WHEREAS, the City Council has agreed to impose penalties consistent with the Best Practices <br />Grid; <br />WHEREAS, the recommended penalty under the Best Practices Grid is as follows: <br />1. $500 civil penalty <br />NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes <br />hereby adopts this Resolution No. 13 -125 finding that a violation of the City Code has occurred <br />and imposing a penalty against Miller's on Main of a $500. <br />Adopted by the Council of the City of Lino Lakes this 25th day of November, 2013. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member S toes z and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Rafferty, Stoesz, Roeser, O'Donnell, Reinert <br />The following voted against same: <br />none <br />ATTEST: <br />u i.j e : artell, City,Cler <br />
