• <br />• <br />• <br />Nature's Refuge <br />EAW Record of Decision <br />page 13 <br />Response: The City thanks the MPCA for this clarification and acknowledges the <br />need for the 401 Certification as one of the needed approvals. <br />• The Minnesota Pollution Control Agency (MPCA) comments that to be effective, <br />infiltration areas should not be compacted during construction or receive construction <br />runoff. Soil ripping may be necessary if soil compaction occurs. <br />• The Minnesota Pollution Control Agency (MPCA) comments that it is a state <br />requirement that three feet of separation be provide between the bottom of the <br />infiltration basins and the seasonally saturated groundwater table. This may be <br />difficult to achieve give the relatively shallow groundwater table. <br />Response: The proposer thanks the MPCA for their comments regarding the <br />infiltration basins. Maintaining the infiltration capacity of the existing soil structure in <br />addition to protecting the infiltration capacity of the constructed facilities will be an <br />important component of project success. <br />• MPCA recommends that information be provided to homeowners at the time of sale <br />to ensure they understand what a rain garden is, how it works, and why they are <br />important. <br />Response: The City will pursue this recommendation with the project proposer. The <br />City has required similar information on previous development projects. The City will <br />create a communication program for new residents and the homeowners' association. <br />Land Use <br />• The Metropolitan Council notes that the density of 2.78 units per acre is below the <br />Metropolitan Council standard for sewered, urban development. The Met Council <br />also notes that a portion of the project currently is not within the City's Metropolitan <br />Urban Service Area so some of the City's undesignated MUSA must be applied. <br />Response: The Metropolitan Council density standard of 3.0 units per acre for <br />sewered urban development is a citywide average for new development. It is correct that <br />this project's density is lower than that. Development of higher density elsewhere in the <br />city will be included in the citywide average. <br />The City allocates MUSA reserve acres at the time of preliminary plat approval. If this <br />project reaches the approval stage, MUSA will be allocated then. <br />
