Council Member Carlson introduced the following resolution and moved its <br />adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 07-58 <br />RESOLUTION APPROVING THE PRELIMINARY PLAT AND ALLOCATION <br />OF 1.5 ACRE OF M.U.S.A FOR COX ESTATES. <br />WHEREAS, the City has received applications for developing an area known as Cox <br />Estates; and <br />WHEREAS, the development requires approval of a preliminary plat and allocation of <br />MUSA; and <br />WHEREAS, a public hearing was held before the Planning & Zoning Board on April 11, <br />2007; and <br />WHEREAS, the proposed plat meets the requirements of the City's Growth <br />Management, Zoning and Subdivision Ordinances; and <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby <br />approves the preliminary plat and MUSA allocation for Cox Estates with the following <br />conditions: <br />1. All lots in the plat, including the existing home, must agree to connect to City <br />utilities. The City will not approve the final plat without legally enforceable <br />assurance that all properties will connect and existing onsite septic systems will be <br />appropriately abandoned. <br />2. Existing wells shall be capped when required by Minnesota Dept. of Health <br />requirements. <br />3. Issues discussed in the City Engineer review memo must be addressed to his <br />satisfaction. <br />4. A development agreement between the city and the developer must be executed prior <br />to the issuance of any building permits for the site. <br />5. Park dedication must be paid in accordance with the city's fee schedule. <br />6. The Rice Creek Watershed District must review the project prior to building permits <br />being issued by the city for any new construction. <br />7. A boulevard tree shall be provided for each lot frontage unless the city forester <br />determines that a suitable existing tree can be substituted. <br />8. This review is based on the following plans and information: <br />• Boundary/Topographic Survey, submitted February 7, 2007 <br />• Preliminary Plat submitted February 7, 2007 <br />• Final Plat submitted February 7, 2007 <br />• Preliminary Grading/Drainage /Erosion Control Plan submitted February 7, 2007 <br />
