• its adoption: Council Member°, Donnel}ntroduced the following resolution and moved CITY OF LINO LAKES COUNTY OF ANOKA RESOLUTION NO. 07 -70 FINDING A VIOLATION OF THE LIQUOR CODE AND IMPOSING PENALTY FOR AMERICAN LEGION POST #566 WHEREAS, the Police Department of Lino Lakes conducted a compliance check on liquor establishments on April 7, 2007; WHEREAS, it was alleged that American Legion Post #566 violated the Lino Lakes Code of Ordinances, Section 701 by selling alcohol to a person underage; WHEREAS, the Police Department of Lino Lakes cited seven individuals for consuming alcohol outside of the American Legion facility on April 14, 2007; WHEREAS, the City Council of Lino Lakes conducted a violation hearing on • May 14, 2007 at 6:00 p.m. and reached a finding that those violations did occur; WHEREAS, the City Council has agreed to impose penalties consistent with the adopted Best Practices Grid; WHEREAS, the recommended penalty under the Best Practices Grid is as follows: • 1. $500 civil penalty for the first violations; 2. $1,000 additional civil penalty and a five -day suspension (stayed) for the second violation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: The City of Lino Lakes hereby adopts Resolution No. 07 -70 Finding a Violation of the Liquor Code and Imposing Penalties for American Legion Post #566. Adopted by the Council of the City of Lino Lakes this 141" day of May, 2007.
