October 26, 1981 <br />97 <br />Mr. Jaworski had requested time under this portion of the agenda, but had <br />withdrawn his request. <br />MINUTES - BUDGET HEARING <br />Mr. Jaworski moved to approve the minutes of October 19, 1981. Seconded <br />by Mr. Kulaszewicz. Mr. McLean questioned the statement 'moved to adjourn' <br />should it state 'moved to continue'? general consensus 'moved to adjourn' <br />is correct. Motion carried, with Mayor Gourley abstaining. <br />AUTHORIZATION OF THE ISSUANCE OF CERTIFICATES OF INDEBTEDNESS <br />Mr. Schumacher reported his actions on the issuance of these Certificates. <br />The interest rate is 10.750, this matter has been certified to the County. <br />Mrs. Elsenpeter moved to adopt the RESOLUTION AUTHORIZING A TAX LEVY TO <br />REPAY THE CERTIFICATE OF INDEBTEDNESS IN THE SUM OF $111,400.00 FOR THE <br />PURCHASE OF POLICE AND STREET EQUIPTMENT IN THE CITY OF LINO LAKES, <br />MINNESOTA. Seconded by Mr. Jaworski. Motion carried unanimously. <br />CABLE TV COMMISSION APPOINTMENT - RESOLUTION 81 -41 <br />This is action ratifying previous action taken by this Council. Mr. McLean <br />moved to adopt Resolution 81 -41 appointing Mrs. Bobbi Volk as Director and <br />Official Representative of the City of Lino Lakes to the Cable Commission. <br />Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />A recess was called at this point in the meeting. The meeting reconvened. <br />PUBLIC HEARING - RESHANAU SHORES <br />1 <br />The public hearing on thisplat was called to order at 8:00 P.M. Mayor <br />Gourley suggested the continuation of this hearing be January 11, 1981. <br />Mr. Jaworski moved to continue this hearing until January 11, 1981 at 8:00 <br />P.M. Seconded by Mrs. Elsenpeter. Motion carried unanimously. <br />ATTORNEY's REPORT <br />Mr. Locher reported that the Judge has not issued his decision by he did <br />state that he would not require the bond to be changed, the temporary <br />trestaining order is outstanding and becomes a temporary injunction. He <br />said there is no case law and is subject to interpretation. He did state <br />that he found the actions of the Council not to be in contempt of Court. <br />Mr. Jaworski felt taht since this action cancells the bond sale and since <br />that it is true, he would see no further action on this matter. <br />Mr. Locher said Judge Dablow did state that he would certify this matter to <br />the Supreme Court. <br />Mayor Gourley asked if both actions are one and the same and Mr. Locher <br />said, Yes, the Judge would certify the entire file to the Supreme Court. <br />Mayor Gourley said he was concerned with the impact this action could have <br />on the bonding capacity of this City and on the band market as a whole in <br />the State of Minnesota. <br />
