146 <br />February 28, 1982 <br />The Special Meeting of the Lino Lakes City Council was called <br />to order at 5:15 P.M., February 18, 1982 by Mayor Benson. Council <br />Members present: Elsenpeter, Kulaszewicz, Reinert (5:22 P.M.). <br />Absent: Marier. <br />Mayor Benson noted that this meeting had been called for the <br />purpose of discussing the pending Supreme Court Case. He asked <br />Mr. Locher to review the case. <br />Mr. Locher noted the five points that the City was contesting <br />and gave a summary of the procedures to be followed at the pre - <br />trial conference to be held February 19, 1982 at 3:00 P.M. <br />Mayor Benson asked if the hearing deals with the sewer project? <br />or does it relate to just bonding? <br />Mr. Locher said, basically, it deals with the interpretation of <br />Chapter 429 of the State Statutes that deals with improvement <br />projects. <br />Mayor Benson asked Mr. Schumacher for a report from the independent <br />bond Counsel. <br />Mr. Schumacher reported that he had contacted Mr. Peter Popovich <br />for his opinion on this matter. Mr. Popovich had been part of the <br />Minnesota State Legislature and had participated in the writing of <br />Chapter 429. Mr. Schumacher reported that the letter had not <br />arrived at the office before this meeting, but Mr. Popovich had <br />contacted him by telephone and given his report orally. <br />Mr. Popovich reported that he felt the dropping of this case would <br />have no effect on future bond sales nor on the City's current bond <br />rating. <br />Mr. Kulaszewicz moved to drop this suit. Seconded by Mr. Reinert. <br />The Motion carried with Mrs. Elsenpeter voting, No. <br />Mr. Kulaszewicz moved to adjourn at 5:26 P.M. Seconded by Mr. <br />Reinert. Motion carried unanimously. <br />These minutes were considered and approved at a regular scheduled <br />Council meeting held on March 22, 1982. <br />a <br />Edna L. Sarner, Clerk- Treasurer <br />
