1 <br />1 <br />ORDINANCE NO. 04 - 85 <br />COUNCIL MEETING <br />April 22, 1985 <br />Page Eleven <br />In any case in which compliance with the foregoing <br />restrictions will create an unnecessary hardship <br />and failure to comply does not interfere with the <br />purpose of the subdivision regulations, the council <br />may waive such compliance by adoption of a resolution <br />to that effect and the conveyance may then be filed <br />or recorded. Any owner or agent of the owner of land <br />who conveys a lot or parcel in violation of the pro- <br />visions of this section shall forfeit and pay to the city <br />a penalty of not less than $100.00 for each lot or parcel <br />so conveyed. The city may enjoin such conveyance or may <br />recover such penalty by a civil action in any court of <br />competent jurisdiction. <br />Section 2. Effective Date. <br />This ordinance shall be effective thirty ( 0) days after <br />its publication. Ordinance #06 -85, Park Dedication, First Reading - Mr. <br />Hawkins explained this is the ordinance to change the <br />park dedication requirements which resulted as the problem <br />with the large lot development. The last sentence dealing <br />with park dedication is the only change. <br />Mr. Marier moved to accept Ordinance #06 -85 for the first <br />reading and dispense with the reading. Mr. Kulaszewicz <br />seconded the motion. Motion carried with Mayor Benson <br />voting no. <br />171 <br />
