• <br />• <br />AGENDA ITEM IF <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: June 25, 2007 <br />TOPIC: Consider Resolution No. 07 -91, Approving <br />renewal of a private kennel license, for Margo <br />Polta of 575 Ash Street <br />VOTE REQUIRED: <br />BACKGROUND: <br />Simple Majority (3/5 Vote) <br />The Lino Lakes City Code, Section 502 regarding Dogs, sets forth the process and <br />conditions for issuance of dog kennel licenses. There are two types of licenses, private <br />and commercial. A private license is required to keep more than two but not more than <br />four adult dogs for private pets with no sale of animals intended. A commercial license <br />is required to keep more than two adult dogs for other purposes such as breeding, <br />boarding, grooming or any merchandising. <br />To obtain either a private or commercial kennel license, it is required that the property <br />where the kennel would be located be approved for a conditional use permit. The <br />Planning and Zoning Board holds a public hearing, with notification to area property <br />owners, on the conditional use only. If a conditional use permit is approved, an <br />application for a license can then be submitted. <br />Margo Polta, 575 Ash Street, was granted a conditional use permit by the City on <br />September 11, 2006 for a private kennel facility that allows her to have three dogs on <br />her property; she was granted a license by the City Council on February 12, 2007. All <br />kennel licenses expire in April with renewal through June. Ms. Polta has applied for <br />renewal of her private kennel license. <br />Based on the requirements of the city code, the Police Department conducted an <br />investigation of Ms. Polta's property and completed a checklist indicating the applicant's <br />conformance to the licensing requirements. It is the recommendation of the Police <br />Department that Ms. Polta's private kennel license be renewed. <br />OPTIONS: <br />1.
