• <br />• <br />• <br />Council Membercarison introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 07 -94 <br />RESOLUTION APPROVING THE CIRCLE PINES, ASH STREET AREA JOINT <br />POWERS AGREEMENT <br />WHEREAS, The City of Lino Lakes and the City of Circle Pines are interested in <br />formalizing cross community water connections in the Ash Street Area. <br />WHEREAS, Circle Pines owns and maintains watermain facilities adjacent to certain <br />parcels located in Lino Lakes. These facilities have the capacity to provide water <br />service to Lino Lakes customers on or near Ash Street. <br />WHEREAS, it is desire of the parties, the City of Lino Lakes and the City of Circle <br />Pines, through this agreement, to provide for water services to customers in the Ash <br />Street area of Lino Lakes. <br />WHEREAS, Minnesota Statues, Section 471.59, provides that two or more <br />governmental units, by agreement entered into through action of their governing bodies, <br />may jointly or cooperatively exercise any power common to the contracting parties or <br />any similar powers, including those which are the same except for the territorial limits <br />within which they exercise. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />Joint Powers Agreement between the City of Circle Pines and the City of Lino <br />Lakes formalizing cross community water co - -ctio s in the Ash Street Area. <br />Bartell, Ci <br />Aso , Mayor <br />Adopted by the Lino Lakes City Council this 9th day of July, 2007. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Membero' Donnelland upon vote being taken thereon, the following voted in favor <br />thereof: <br />Carlson, O'Donnell, Reinert, Stoltz, Bergeson <br />The following voted against same: <br />none <br />Whereupon said resolution was declared duly passed and adopted. <br />
