• <br />• <br />• <br />Council Member Reinert introduced the following resolution and moved for its <br />adoption: <br />RESOLUTION NO. 07 -145 <br />RESOLUTION APPROVING CHANGE ORDER NO. 5 <br />LAKE DRIVE /I35W IMPROVEMENT PROJECT <br />WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the City <br />awarded the construction contract for the Lake Drive /I -35W Improvement Project to Lunda <br />Construction Company, and <br />WHEREAS, with the City's approval of Change Order No. 2, the median construction on <br />C.S.A.H. 23 is eliminating the four (4) inch concrete walk and replacing it with an irrigated <br />landscape system, and <br />WHEREAS, Change Order No. 2 reduced the quantity of four (4) inch concrete walk by 23,758 <br />square feet leaving a quantity balance of 4,680 square feet, and <br />WHEREAS, The Contractor has requested a modification of the Contract Bid Price in <br />accordance with Mn /DOT Specification 1903 for contract items that underun Tess than 75% of <br />the contract bid quantity and the Engineer has determined that this request is justified. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />1. Change Order No.5, in the amount of $1,825.20, is hereby approved. <br />Jo J.
