• <br />• <br />SITE NAME: MINC Lino Lakes <br />SITE NUMBER: <br />MOSS & BARNETT /8/31/07 <br />AMENDMENT NO. 1 TO SITE LEASE AGREEMENT <br />This AMENDMENT NO. 1 TO SITE LEASE AGREEMENT ( "Amendment ") is made <br />this day of , 200 by and between the City of Lino Lakes, a <br />Minnesota municipal corporation ( "Landlord ") and Verizon Wireless (VAW) LLC d/b /a Verizon <br />Wireless ( "Tenant "), with its principal offices located at One Verizon Way, Mail Stop 4AW100, <br />Basking Ridge, New Jersey, 07920, with reference to the facts set forth in the Recitals below: <br />RECITALS <br />A. Landlord and Tenant, or their predecessors in interest, are parties to a Site Lease <br />Agreement dated February 14, 2000 ( "Agreement "), whereby Landlord has leased a portion of <br />Landlord's Property (as defined on Exhibit A in the Agreement) to Tenant to install, maintain <br />and operate a communications antenna facility, equipment, cabinets and an accessory building, <br />and uses incidental thereto, as situated substantially as shown on Exhibit B attached to the <br />Agreement. The Agreement commenced when fully executed on February 14, 2000 and the <br />annual rent commenced on February 14, 2000, which is the Effective Date of the Agreement. <br />The Initial Term commenced on February 14, 2000, and terminated on December 31, 2005. The <br />Agreement automatically renewed for an additional five (5) year term and will automatically <br />renew for two (2) additional five (5) year terms unless the Tenant sends notice of non - renewal to <br />Landlord no less than ninety (90) days prior to the expiration of any Renewal Term. The <br />Agreement is currently scheduled to terminate December 31, 2020. <br />B. Landlord and Tenant desire to (i) provide additional Leased Premises adjacent to <br />the water tower for an emergency power generator, (ii) revise the legal description of Landlord's <br />Property, (iii) provide for an increase in the rent payable to Landlord under the Agreement for <br />the additional Leased Premises for the emergency power generator space, (iv) provide an <br />updated address for notice for Tenant, and (v) provide for additional extensions after all other <br />Renewal Terms have expired. <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the facts contained in the Recitals above, the <br />mutual covenants and conditions below, and other good and valuable consideration, the receipt <br />and sufficiency of which are hereby acknowledged, the parties agree as follows: <br />1. ADDITIONAL LEASED PREMISES. Additional ground space as described and <br />shown on attached Exhibit B -1 is hereby provided by Landlord for Tenant's use to place an <br />emergency power generator. <br />2. LEGAL DESCRIPTON OF THE PROPERTY.
