The City will design traffic calming techniques into the Robinson Drive street construction <br />such as bump outs at trail crossings, tree landscaped boulevards and parking only on south side <br />of the street. <br />3. Drainage concerns <br />The assistant City Engineer and Developer's engineer met with some of the residents after the <br />Planning & Zoning Board meeting to discuss their drainage concerns. <br />Final Plat <br />A land use application for PUD Final Plan/Final Plat for Century Farm North 6th Addition shall <br />be required. At such time, the developer shall enter into a Development Contract and other <br />documents as the City deems necessary. The boundary of the proposed Century Farm North 6th <br />Addition final plat shall include Outlot A, Century Farm North 5th Addition, the vacated <br />parkland and the Morell parcel. <br />Petition and Waiver Agreement <br />One condition of Resolution 14-43 approving the Amendment to the PUD Development Stage <br />Plan/Preliminary Plat was the submittal of a Petition and Waiver Agreement for road <br />construction, utility extension and right-of-way dedication for Robinson Drive. The abutting <br />property owners, Century Farm North Development, Inc. and Jeffrey E. Morell, have signed a <br />Petition and Waiver Agreement agreeing to assessments and right-of-way dedication. <br />The agreement allows for the City to levy against the property up to $950,000 for the <br />construction of the improvements and waives all requirements for special assessments under <br />Minnesota Statutes, Chapter 429 and City Charter requirements. The agreement also provides <br />for the dedication, at no cost to the city, permanent right-of-way and temporary easements <br />necessary for the extension of Robinson Drive and public utilities. <br />RECOMMENDATION <br />The Planning & Zoning Board and staff recommend approval of the rezoning, amendment to <br />the PUD Development Stage Plan/Preliminary Plat and Petition and Waiver Agreement for <br />Century Farm North subject to the conditions listed in Resolution 14-43. <br />ATTACHMENTS <br />1.
