1 1 1 December 10, 1979 43 Mr, Zelinka moved to deny the zoning on Block 3 of the plat. Seconded by Mr. Schneider. Motion declared passed. Mr. McLean moved to close the hearing at 10:15 P.M. Seconded by Mr. Zelinka. Motion declared passed. Mr. Locher reported that the matter of Mr. Donald Holzmer's home had been completed. All that is necessary is the variance to the ceiling height in the basement area. This can be done by variance. Mr. McLean moved to grant a variance for the difference in height require- ment for the basement area, this variance to be filed with the County Recorder to become a part of the abstract. Seconded by MR. Zelinka. Motion declared passed. The Forest Tagg matter is scheduled for trial Wednesday, December 12, 1979 at 10:30 A.M. Mr. Locher reported that he and delivered the transcripts of the minutes to the bond Attorney. There are a few minor details to be completed, but these must wait for a delivery date. Mr. Locher had checked the Letter of Agreement from the Metropolitan Waste Control Commission and had found only one area that he questioned. This was the area of repairs being done by the City on the MWCC equipment. The City would be reimbursed on a 50/50 basis. There was some discussion on this. Mr. Zelinka moved to approve this contract and to authorize the Mayor and Clerk to sign the agreement. Seconded by Mr, Kulaszewicz. Motion declared passed. Mr. Locher said there was a deed for the Tot Lot in Sunset Oaks, This will be verified as to the legal description before acceptance. On the matter of assisting Circle Pines to collect unpaid gas bills, Mr, Locher reported there is no legal means for this City to participate. He felt the only way is to get special legislation. Mr. Zelinka will recommend this course of action at the next Utility Commission meeting and Mr. Zelijka moved that Mr. Schumacher wirte a letter of support for any action that circle Pines may take in the area of special legislation with copies to go to Lino Lakes Senator and Representative. Seocnded by MR. Kulaszewicz, Motion declared passed. There was discussion on the offer of the Corps of Engineers to assist in the clean up of the Park on 7th avenue. More on this at a later date. Mr. Zelinka moved to approve the use of the Hall on January 22, 1980 by the DFL. Seconded by Mr. McLean. Motion declared passed. Mr. McLean moved to adjourn at 10:55 P.M.
