Council Minutes <br />May 27, 1980 <br />particular use and not for a particular person or firm ", and <br />WHEREAS, Ordinance No. 56 in Section 5.04 (A) also states <br />"Special Use Permits shall be considered administratively <br />equivalent to a rezoning, and the same requirements and <br />procedures shall apply ", and, <br />WHEREAS, Ordinance No. 56 in Section 5.02 (C) and Minnesota <br />State statue No. 462. 357, subdivision No. 3 calls for a <br />public hearing to be held on any rezoning. and, <br />WHEREAS, no Council of the City of Lino Lakes has ever held <br />a public hearing to revoke the said Special Use Permit. <br />BE IT THEREFORE RESOLVED, that Special Use Permit No. 27 <br />issued to Lakes Development Company on March 9, 1970 does <br />survive under all Ordinances and regulations existing at <br />this time in the City of Lino Lakes. <br />BE IT FURTHER RESOLVED that the developer may proceed to <br />present plans for development of the lands covered by said <br />Special Use Permit before the Planning Commission of the <br />City of Lino Lakes, <br />Mr. McLean asked Mr. Locher if there were any problems with this Resolution and <br />Mr. Locher said, No, as long as all Special Use Permits were treated equally. <br />There was discussion from the audience to include Mr. Cody and Mr. Benson, both <br />who objected to the use of the lands for the construction ,of Quads. <br />Mayor,Gorirley pointed out that the issue here Is not,the use.of the land,but the <br />survival gf,the special use permit. This special permi.t.was considered on a, <br />request from the,Planning and,Zoning Board before,they would,preceed with the <br />plat that had been,presented to them <br />There was discussion on the many facets of the provisions of the Ordinance in <br />regard to the issuance of Special Use Permits and the revoking of said Permits. <br />Mri Kulaszewilcz moved to approve this Resolution as presented. iSeconded by Mr. <br />Jaworski. Motion carried unanimously. <br />Consideration . of the financial report for the ,Month of April was next on the <br />agenda. ;Mr, Schumacher presented the financial report and discussed the quest- <br />ion from the Council. Mr. Schumacher told the Council that he felt this report <br />would be much more accurate at the end of six months - it hard to project a <br />realistic figure on a month to month basis. He explained that, even though <br />some oil the monthly figures are over the anticipated amount for the month, the <br />expenditures are not over budget. <br />Mr. Jaworski moved to table consideration of the purchase of a chipper. Second- <br />ed by Mr. McLean. Motion carried unanimously. <br />The requests from St. Josephs's Church fora special permit for Beer and Bingo <br />at their annual event in August Mr Locher.said that within the past.year a <br />law has been passed that sayis there must be someone in charge of the bingo and <br />there must also be a $10,000.00 bond., This must be a designated person to .keep <br />
