COUNCIL MINUTES April 28, 2014 <br />DRAFT <br />136 <br />137 Paul Whaley, 6200 Laurene, told the council that the proposed pond will fill with water as soon as it <br />138 is dug. He is a resident in the area and feels strongly that there will be more water run off with this <br />139 development and it will be a problem for other properties. City Engineer Wedel said the city intends <br />140 to watch development very carefully. If there are any issues that arise, the city will work on them. He <br />141 can attest that staff works hard to put the best possible plans in place. <br />142 <br />143 Mayor Reinert explained the city's obligation when plans are received that meet requirements. The <br />144 council has been drilling down as much as possible on the plans though. He applauds the <br />145 neighborhood for engaging in this discussion and believes that should result in a better situation at the <br />146 end of the day. <br />147 <br />148 When a resident requested that staff of the Rice Creek Watershed District (RCWD) walk the site with <br />149 him, Community Development Director Grochala explained that this site doesn't require a permit <br />150 from the RCWD because it isn't considered a substantial disturbance to the watershed. The city is <br />151 required to review and approve the drainage plans and the City Engineer has done that. <br />152 <br />153 Council Member Roeser suggested that the city require that the water from both sides of the <br />154 development be run to the new storm pond rather than half to the street. Mr. Wedel explained that <br />155 the city cannot require that but could request it. The city can also look at the possibility of ditches. <br />156 Community Development Director Grochala added that both Linda Avenue and Laurene Street are <br />157 scheduled for inclusion in the city's storm water management program. <br />158 <br />159 Council Member Rafferty added that he has been involved in this project review at the Planning and <br />160 Zoning Committee level. He appreciates the amount of neighborhood involvement it has received. <br />161 <br />162 Council Member Rafferty moved to approve the first reading of Ordinance No. 05 -14 as presented. <br />163 Council Member Roeser seconded the motion. Motion adopted on a unanimous voice vote. <br />164 <br />165 Council Member Roeser moved to approve Resolution No. 14 -34 as presented. Council Member <br />166 Kusterman seconded the motion. Motion adopted on a unanimous voice vote. <br />167 <br />168 6C — Resolution No. 14 -37 Approving the 1st Amendment to Wellhead Protection Plan Joint <br />169 Powers Agreement — Community Development Director Grochala reviewed the requirement for the <br />170 city to have a protection plan for its wellheads. The protection plan is handled through a joint powers <br />171 agreement with other cities. The amendment proposed allows the addition of another city. Council <br />172 Member Roeser received assurance that the joint powers agreement doesn't bind the city in any way <br />173 that would cause difficulties in the future. <br />174 <br />175 Council Member Roeser moved to approve Resolution No. 14 -37 as presented. Council Member <br />176 Kusterman seconded the motion.
