Mr. Reinert asked what did he <br />expect to accomplish by rehashing the matter again. Mr. Polski asked <br />that the owners have an opportunity to be heard. Mr. Bisel said he <br />would stand by his original motion and did not want to hear it again. <br />He said he had not seen any evidence that anything had been done on <br />the matter and moved to repeat his original motion which was to deny <br />the CUP request and require that the owner submit a plan that will <br />equalize the lots or move out the extra dirt and submit plans that <br />conform to this motion by June 15, 1987. Mr. Bohjanen seconded the <br />motion. Motion carried unanimously. <br />Mr. Polski said he is trying to gain an opportunity to present reasons <br />for not denying the permit because he felt the reasons stated in the <br />original motion are not objective and have no basis. Mr. Reinert said <br />that his comments were at odds with the City Attorney. <br />Roland Ford Update - Mr. Kluegel read a letter written by John Stein <br />of the DNR regarding the Ford cleanup litigation. Mr. Stein indicated <br />that there is a deadline of May 2, 1987 for Mr. Ford to present a plan <br />indicating how his property will conform to all federal, state, county <br />and city codes and ordinances. Litigation by this City is proceeding <br />and Mr. Kluegel has not had any response from the Fords regarding this <br />matter. <br />IMayor Benson noted that the area is getting worse and that Mr. Ford is <br />still hauling into his property. Mr. Kluegel told the Council that he <br />has word that Mr. Ford is using his property for a transfer station <br />for solid waste and Anoka County is looking into this matter. <br />Mr. Reinert asked what can be done to correct this situation. He <br />noted that Mr. Ford has violated the codes, has been convicted several <br />times and has even been sentenced to jail. Mr. Hawkins explained that <br />he will probably be sentenced to longer periods in jail with each <br />conviction. Mr. Hawkins also noted that injunctive relief can be <br />sought and the PCA could be asked to investigate if the City feels Mr. <br />Ford is violating pollution regulations especially when water quality <br />could be affected. Mr. Schumacher asked why the County has not <br />prosecuted Mr. Ford for his violations. Mr. Kluegel explained that <br />Mr. Christianson of the County Health Department has tried several <br />times but the complaint gets to the County Attorney's desk and then <br />does not go anywhere from there. <br />Mr. Reinert moved to have Mrs. Langfeld, County Commissioner, take <br />administrative leadership along with Mr. Kluegel and Mr. Hawkins and <br />have this in place by the next Council meeting.
