AGENDA ITEM 1B <br />STAFF ORIGNINATOR: Jean Viger, Deputy Clerk <br />MEETING DATE: January 26, 2004 <br />TOPIC: Consider Resolution 04 -13, Approving Application <br />for Temporary On -Sale Liquor License and <br />Resolution 04 -14, Approving Application to Conduct <br />Off -Site Gambling, Circle -Lex Lions Club <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />The Circle -Lex Lions Club is planning its annual fundraising dinner for March 27, 2004 at St. <br />Joseph Catholic Church, 171 Elm Street. <br />A licensed organization, under the State Gambling Statutes, may conduct lawful gambling on a <br />site other than the organization's permitted premises for one day per calendar year or within a 12 <br />consecutive -day period in a calendar year in connection with a county fair, church festival or a <br />civic celebration. The Circle -Lex Lions Club has submitted an application, for council approval, <br />to conduct a raffle at this annual fundraiser. As required by the Gambling Control Board, the <br />approval must be in the form of a resolution. <br />The Lions Club has also submitted an application requesting approval for a 1 to 4 Day Temporary <br />On -Sale Liquor License. This license is necessary to allow the Lions Club to mix and dispense <br />liquor. The mixed drinks will be served as part of the dinner and will not be sold separately. The <br />temporary on -sale license application must be approved by the city council and forwarded, by the <br />organization, to the Alcohol & Gambling Enforcement Division at least 30 days prior to the <br />event. <br />City policy requires a background investigation each time a permit or license application is <br />received. The Lino Lakes Police Department conducted an investigation and found no reason to <br />deny the application. <br />The completed applications and a copy of the certificate of liability insurance are on file in the <br />city clerk's office. <br />OPTIONS: <br />1. Approve applications for the 1 to 4 day temporary on -sale liquor license and the off -site <br />gambling license. <br />2. Deny applications. <br />3. Return to staff for further information. <br />RECOMMENDATION: <br />1. Approve applications. <br />
