AGENDA ITEM 7 C. ii. <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: February 23, 2004 <br />TOPIC: Resolution 04 -24, Final Plat <br />Miller's Crossroads <br />VOTE: 3/5 <br />BACKGROUND <br />The City Council approved the preliminary plat for Miller's Crossroads with Resolution 03 -142 <br />on September 22, 2003. The Planning & Zoning Board reviewed the final plat on January 14th. <br />The rezoning of the site is in effect. The City Attorney has reviewed the title commitment. The <br />City Engineer has prepared a development agreement. Conditions of approval have been <br />satisfied or included in the development agreement. <br />The fmal plat conforms to the approved preliminary plat. However, a reference to 'A section line <br />on sheet 2 of 3 sheets should be changed to match the reference on sheet 3 of 3. This must be <br />done prior to the City signing the mylars. <br />A surveying discrepancy is illustrated by Outlot U at the southern border of the site. <br />Occasionally, surveys discover such inconsistencies. In order to resolve this, deeds to the <br />neighboring property owners have been negotiated. The small pieces must be combined with the <br />neighbors' lots rather than becoming separate tax parcels. The City should receive <br />documentation that the neighboring land owners understand and agree to accept the property to <br />be combined with their existing lots. The lot combination forms must be filed with the final . plat. <br />The pond will be adjusted to accommodate the land shown as Outlot U. <br />This project includes a phasing plan in four phases, 2003 through 2006. Since the first phase did <br />not occur before winter, the first two phases are being combined in this final plat. This is <br />acceptable under the city ordinances. <br />The developer is requesting an amendment to the phasing plan that would change the specific <br />buildings that are constructed in certain phases.
