RESOLUTION NO. 2004 46 <br />A RESOLUTION ACKNOWLEDGING THE CITY OF LINO LAKES'S <br />COMPLIANCE WITH THE HEALTH INSURANCE PORTABILITY AND <br />ACCOUNTABILITY ACT <br />WHEREAS, the City Council of the City of Lino Lakes is the official governing body of <br />the City of Lino Lakes; and, <br />WHEREAS, the Federal Health Insurance Portability and Accountability Act of 1996 (HIPAA) <br />requires that all health plans, health care providers and health care clearinghouses implement <br />regulations for the purposes of ensuring the portability of health care coverage when moving to a new <br />job, reducing paperwork by conducting electronic payment transactions, and securing the privacy of <br />individual protected health information; and, <br />WHEREAS, the City of Lino Lakes, in limited functions, acts as a health plan and a health care <br />provider and is therefore subject to HIPAA regulation; and <br />WHEREAS, HIPAA regulations require that the City designate itself as a covered entity; and <br />WHEREAS, the City is required to develop internal policies and procedures to carry-out all <br />HIPAA regulations; and <br />WHEREAS, the City must name a Privacy and Complaint Official to respond to HIPAA- related <br />questions or grievances; and <br />WHEREAS, HIPAA regulations require that the City provide affected clients with a <br />Notice of Privacy Practices, informing clients of their privacy rights. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES IN REGULAR MEETING ASSEMBLED, that the City of Lino Lakes is designated <br />as a Covered Entity under the Federal Health Insurance Portability and Accountability Act of 1996; and <br />
